中國海事仲裁委員會
中國海事仲裁委員會（以下簡稱“中國海仲”）根據(jù)中華人民共和國國務(wù)院1958年11月21日的決定，于1959年設(shè)立于中國國際貿(mào)易促進(jìn)委員會內(nèi)；是我國唯一以解決海事海商、交通物流爭議為特色，并涵蓋其他所有商事爭議的全國性、國際化仲裁機構(gòu)。
中國海仲總部設(shè)在北京，在上海、天津、重慶、深圳、香港、福建設(shè)有分會，在浙江等地設(shè)有自貿(mào)區(qū)仲裁中心；在國內(nèi)主要港口城市，大連、天津、青島、寧波、廣州、舟山、南寧設(shè)有辦事處。為滿足行業(yè)仲裁的需要，中國海仲下設(shè)物流爭議解決中心、漁業(yè)爭議解決中心、海事調(diào)解中心、航空爭議仲裁中心、航空爭議調(diào)解中心、計量爭議仲裁中心、救助打撈爭議調(diào)解中心、建筑工程爭議仲裁中心等業(yè)務(wù)中心。幾十年的仲裁實踐，培養(yǎng)造就了秉承職業(yè)道德、業(yè)務(wù)水平精湛、實踐經(jīng)驗豐富的海事仲裁員隊伍和勤勉盡責(zé)、專業(yè)高效的辦案秘書隊伍。中國海仲自成立以來已作出幾千件仲裁裁決，其裁決的獨立性、公正性、專業(yè)性和權(quán)威性得到國內(nèi)外的普遍認(rèn)可，已成為國際重要的仲裁機構(gòu)，為促進(jìn)國內(nèi)國際經(jīng)濟(jì)貿(mào)易和航運的發(fā)展做出了重要貢獻(xiàn)。
受案范圍
（一）仲裁委員會根據(jù)當(dāng)事人的約定受理下列爭議案件：
1.海事、海商爭議案件；
2.航空、鐵路、公路等相關(guān)爭議案件；
3.貿(mào)易、投資、金融、保險、建筑等其他商事爭議案件；
4.當(dāng)事人協(xié)議由仲裁委員會仲裁的其他爭議案件。
（二）前述案件包括：
1.國際或涉外爭議案件；
2.涉及香港特別行政區(qū)、澳門特別行政區(qū)及臺灣地區(qū)的爭議案件；
3.國內(nèi)爭議案件。
示范條款
凡因本合同引起的或與本合同有關(guān)的任何爭議，均應(yīng)提交中國海事仲裁委員會，按照申請仲裁時該會現(xiàn)行有效的仲裁規(guī)則進(jìn)行仲裁。仲裁裁決是終局的，對雙方均有約束力。

CHINA MARITIME ARBITRATION COMMISSION (CMAC)
China Maritime Arbitration Commission (“CMAC”), established within the China Council for the Promotion of International Trade on 22 January 1959 in accordance with the Decision made by the State Council of the People’s Republic of China on 21 November 1958, is the only national and international arbitration institution that is specialized in resolving admiralty, maritime, transportation, logistics disputes, and covers all other commercial disputes.
CMAC has its headquarters in Beijing, with sub-commissions in Shanghai, Tianjin, Chongqing, Shenzhen, Hong Kong and Fujian, pilot free trade zone arbitration centers in Zhejiang and other places, and liaison offices in major coastal cities such as Dalian, Tianjin, Qingdao, Ningbo, Guangzhou and Zhoushan. In order to meet the diversified needs for various industries, CMAC has established the Aviation Dispute Mediation Center, the Aviation Dispute Arbitration Center, the Measurement Dispute Arbitration Center, the Logistics Dispute Resolution Center, the Fishery Dispute Resolution Center, the Maritime Mediation Center, Rescue & Salvage Dispute Mediation Center, Construction Project Dispute Arbitration Center, etc.
Decades of arbitration experiences have cultivated a rank of maritime arbitrators with professional ethics, strong professional skills, and abundant practical experience, as well as a team of case managers with diligence, profession and efficiency. CMAC has made thousands of maritime arbitral awards since its establishment, and such awards being independent, impartial, professional and authoritative have been widely recognized at home and abroad. CMAC has become an important international arbitration institution and made great contribution in promoting domestic and international economic trade and shipping.
CMAC’s Jurisdiction
1. CMAC accepts cases based on the agreement of the parties, including:
(a) disputes arising from admiralty, maritime;
(b) related disputes arising from aviation, railways, highways, etc.;
(c) other commercial disputes arising from trade, investment, finance, insurance, construction, etc.;
(d) other cases where the parties have agreed to refer their disputes to CMAC for arbitration.
2. the preceding cases include:
(a) international or foreign-related disputes;
(b) disputes related to the Hong Kong Special Administrative Region, the Macao Special Administrative Region and the Taiwan region;
(c) domestic disputes.
CMAC Model Arbitration Clause
“Any dispute arising from or in connection with this Contract shall be submitted to China Maritime Arbitration Commission (CMAC) for arbitration which shall be conducted in accordance with the CMAC’s arbitration rules in effect at the time of applying for arbitration. The arbitral award is final and binding upon both parties”.
