中國國際貿(mào)易促進委員會海峽兩岸仲裁中心
海峽兩岸仲裁中心(The Arbitration Center Across The Straits,簡稱ACAS),是中國國際貿(mào)易促進委員會/中國國際商會組織設(shè)立的常設(shè)仲裁機構(gòu),由中國國際經(jīng)濟貿(mào)易仲裁委員會組建和管理,于2015年12月29日在福建省平潭綜合實驗區(qū)正式成立。
海峽兩岸仲裁中心致力于為兩岸當事人提供更為便利的仲裁服務。仲裁中心主要以仲裁的方式,也可以調(diào)解和其他非訴訟爭議解決方式,解決兩岸當事人約定由仲裁中心管轄的民商事(包括海事)合同和其他財產(chǎn)權(quán)益糾紛。此外,海峽兩岸仲裁中心還可根據(jù)當事人約定受理國內(nèi)爭議案件、涉港澳爭議案件、涉外或國際爭議案件,也可根據(jù)有關(guān)部門的授權(quán)受理其他糾紛。
獨立、公正、專業(yè)、優(yōu)秀的仲裁員隊伍是海峽兩岸仲裁中心保障辦案質(zhì)量的有力基石。海峽兩岸仲裁中心設(shè)立《仲裁員名冊》,并制定《仲裁規(guī)則》。中心聘請了近200位海峽兩岸知名法律人士和其他專業(yè)人士擔任仲裁員,其中包括25位臺灣地區(qū)仲裁員。
海峽兩岸仲裁中心積極開展合作與交流,與法院和相關(guān)機構(gòu)簽訂合作機制,加強訴訟與仲裁、調(diào)解以及其他非訴訟糾紛解決方式之間的有機銜接,為當事人提供高效多元的爭議解決方式。
示范性仲裁條款
凡因本合同引起的或與本合同有關(guān)的任何爭議,均應提交海峽兩岸仲裁中心,按照申請仲裁時該中心現(xiàn)行有效的仲裁規(guī)則進行仲裁。仲裁裁決是終局的,對雙方均有約束力。
和解協(xié)議中示范性仲裁條款
雙方當事人一致同意將本和解協(xié)議提交海峽兩岸仲裁中心,由雙方當事人共同選定或共同委托或由仲裁中心主任指定一名獨任仲裁員成立仲裁庭,由仲裁庭按照其認為適當?shù)某绦蜻M行審理并作出裁決。具體仲裁程序和期限不受仲裁中心仲裁規(guī)則的限制。

仲裁裁決的執(zhí)行
仲裁當事人應按照仲裁裁決書中規(guī)定的期限自動履行裁決;裁決書未寫明履行期限的,應當立即履行。如當事人一方不履行仲裁裁決的,另一方當事人可依據(jù)法律規(guī)定向有管轄權(quán)的人民法院申請強制執(zhí)行。
如果被執(zhí)行人的住所地或財產(chǎn)所在地在中國境外,而且所在國家也加入了1958年《紐約公約》的,申請人可依據(jù)該公約向該國有管轄權(quán)的法院申請強制執(zhí)行。
此外,海峽兩岸仲裁中心的仲裁裁決也可根據(jù)有關(guān)規(guī)定在臺灣、香港、澳門得到認可和執(zhí)行。

THE ARBITRATION CENTER ACROSS THE STRAITS
The Arbitration Center Across the Straits (ACAS), established on December 29, 2015 in Pingtan Comprehensive Experimental Zone, Fujian Province of P.R.China, is a permanent arbitration organization established by China Council for the Promotion of International Trade (CCPIT)/China Chamber of International Commerce (CCOIC) and administered by China International Economic and Trade Arbitration Commission (CIETAC).
ACAS is committed to providing the parties on both sides of the Taiwan Straits with more convenient arbitration services. ACAS mainly accepts cases involving civil disputes, commercial disputes and maritime disputes by means of arbitration, meditation and other ADR methods, based on an agreement of the parties. Besides, ACAS can accept cases involving domestic disputes, disputes related to Hong Kong Special Administrative Region and Macao Special Administrative Region as well as international or foreign-related disputes. ACAS can also accept cases including other disputes with the authorization of relevant departments. The independence, impartiality, professionalism, and illustriousness of our arbitrators are the guarantee of our case quality. ACAS formulates Arbitration Rules and establishes a Panel of Arbitrators which contains nearly 200 well-known legal experts and other professionals from Mainland China, Hong Kong, Macao and Taiwan.
ACAS conducts active exchanges and cooperation with local courts and related institutions to strengthen the links between litigation, arbitration and mediation, and provides efficient and diversified dispute solutions for parties.
Model Arbitration Clause
Any dispute arising from or in connection with this Contract shall be submitted to ACAS for arbitration which shall be conducted in accordance with the Center's arbitration rules in effect at the time of applying for arbitration. The arbitral award is final and binding upon both parties.
Model Arbitration Clause in a Reconciliation Agreement
Both parties may, based on the settlement agreement reached between them, request ACAS to constitute an arbitral tribunal to render an arbitral award in accordance with the terms of the settlement agreement. Unless the parties jointly nominate or entrust the Chairman of ACAS to appoint, the Chairman of ACAS shall appoint a sole arbitrator to form such an arbitral tribunal, which shall examine the case in an appropriate procedure and render an award in due course. The specific procedure and time period for rendering the award shall not be subject to other provisions of these Rule.
Arbitral Proceedings
Apply for arbitration
○ Submit a Request for Arbitration in writing
○ Attach the relevant documents and other evidence on which the Claimant’s claim is based upon the Request of Arbitration
○ Prepay the arbitration fee in advance in accordance with
Arbitration Fee Schedule
General Procedure
○ The amount in dispute is above RMB5,000,000, or by agreement between both parties
○ The arbitral tribunal shall be composed of three arbitrators, unless parties have agreed otherwise
○ Oral hearing or written hearing
○ Render an arbitral award within 6 months from the date on which the arbitral tribunal is formed
Summary Procedure
○ The amount in dispute is between RMB500,000 and RMB5,000,000, unless parties have agreed otherwise
○ A sole arbitrator to form an arbitral tribunal to act singly, unless parties have agreed otherwise
○ Oral hearing or written hearing
○ Render an arbitral award within 3 months from the date on which the arbitral tribunal is formed
Small Claim Procedure
○ The amount in dispute does not exceed RMB500, 000, unless parties have agreed otherwise
○ A sole arbitrator to form an arbitral tribunal to act singly
○ Oral hearing or written hearing
○ Render an arbitral award within 45 days from the date on which the arbitral tribunal is formed
Performance of Award
The parties shall perform the arbitral award within the time period specified in the award. If no time period is specified in the award, the parities shall perform the award immediately. If one party fails to perform the award, the other party may apply to a competent court for enforcement of the award in accordance with the law.
If the person subjected to execution has his domicile or property located outside China, on condition that the country has also joined the New York convention of 1958, the applicant may apply to a competent court for recognition and enforcement of the award in accordance with the Convention.
The arbitral award of ACAS could also be recognized and implemented in Taiwan, Hong Kong and Macao in accordance with relevant stipulations.
